The ‘E’ of ESG: New EU Ecodesign Rules for Unsold Consumer Products

The European Union is advancing sustainability through new regulations targeting the environmental impact of unsold consumer products. The EU Ecodesign Regulation for Sustainable Products (EU) 2024/1781 (ESPR) introduces strict transparency and destruction bans aimed at reducing waste and encouraging more sustainable business practices.

Key Highlights of the EU Ecodesign Regulation (ESPR)

Transparency and Reporting Obligations

  • Scope: Rules apply to all products placed on the EU market, affecting both EU-based and non-EU companies.
  • Enterprise Size: Large enterprises must begin reporting as early as 2026 based on 2025 data; medium-sized enterprises will join from 19 July 2030.
  • Required Disclosures: Companies must annually disclose data on:
    • Quantity and weight of unsold products discarded.
    • Reasons for disposal, including any derogations.
    • Waste treatment methods: reuse, recycling, recovery, and disposal proportions.
    • Prevention strategies implemented or planned to avoid destruction of unsold goods.
  • Disclosure Format: Reports must be accessible either via the company’s website or within sustainability reports per the EU Accounting Directive. Consolidated reporting by parent companies is permitted for subsidiaries.

Ban on Destruction of Unsold Goods

  • Effective from 19 July 2026, the ESPR introduces a ban on the destruction of certain unsold consumer products.

  • This aims to combat the widespread environmental and economic harm caused by destroying valuable goods especially amplified by online sales growth.

  • Harmonized EU rules replace fragmented national laws to create a level playing field across Member States.

  • Derogations to destruction bans will be detailed in delegated regulations to be finalized by Q3 2025. ### Enforcement and Penalties

  • EU Member States will develop national penalty regimes for non-compliance.

  • For example, Germany’s previous penalties for violations under Ecodesign rules reached up to €50,000 per incident, potentially higher if illegal profits were made.

Draft Implementing Rules Detailed

  • The EU Commission plans to finalize two key regulations by Q3 2025:
    1. Implementing act on disclosure requirements (Article 24 ESPR)
    2. Delegated regulation on exceptions to the destruction ban (Article 25 ESPR)
  • A draft for the disclosure implementing regulation emphasizes:
    • A standardized reporting format for comparability.
    • Product category classification using the Combined Nomenclature system.
    • Assurance requirements, including limited auditor verification of reports for entities obligated under the EU Accounting Directive.

Implications for Businesses

Enterprises operating within or exporting to the EU must prepare for compliance with these new sustainability requirements. This involves:

  • Establishing systems to track unsold products and their disposal routes.
  • Enhancing transparency through detailed public reporting.
  • Adjusting procurement and inventory management to minimize waste.
  • Preparing for external verification of sustainability disclosures.
